Terms of service
Last updated 2026-09-26
These terms are the agreement between you and Kismaro, the service at kismaro.com. By using it you agree to them. If you do not agree, please do not use the service.
Kismaro is operated by Tech Interval LLC, a limited liability company registered in the State of New Mexico, United States, at 1209 Mountain Road Pl NE Ste R, Albuquerque, NM 87110, United States. Throughout these terms "we", "us" and "our" mean Tech Interval LLC, and "you" means the person using Kismaro. You can reach us by email at [email protected].
1. Who may use it
You must be at least 18 years old. There is no exception to this and no parental-consent route. You must also have the legal capacity to enter an agreement and must not be barred from using the service under any law that applies to you.
You confirm a date of birth once, on its own screen, when you first sign in. It cannot be edited afterwards. Giving a false date of birth is a breach of these terms and, where a minor is involved, is the one thing that results in a permanent ban with no appeal.
If we have banned you, you may not come back under a new account, a new email address or a different device. Doing so is itself a breach.
2. What the service is, and what it is not
Kismaro connects you at random with another person for a video, voice or text conversation. Beyond the filters you set — mode, country, interests — we do not choose who you meet, and we cannot predict what another person will say or do.
Kismaro is not a dating service, not an introduction agency and not a broadcasting platform. It is free. There is no paid tier, no subscription and no payment of any kind, so nothing in these terms concerns billing, refunds or renewals.
3. Your account
Keep your sign-in method secure. You are responsible for everything done through your account, including by anyone you let use your device. Tell us at [email protected] if you believe someone else has access to it.
You may hold one account. Creating additional accounts to evade a ban, a report or a filter is a breach of these terms.
4. What you may not do
You agree to follow our community rules. In addition, and without limiting them, you must not:
- involve anyone under 18 in any way, or present yourself as being under 18;
- transmit sexual content, nudity, or sexual conduct of any kind;
- harass, threaten, stalk, defame or incite hatred or violence against anyone;
- record, screenshot, stream or republish another person without their consent;
- impersonate anyone, or misrepresent who you are in order to obtain something;
- advertise, solicit, recruit, or promote a product, service, site or cause;
- transmit malware, phishing links, or anything designed to damage or deceive;
- show pre-recorded video, a photograph, or another person's image as though it were your own camera, or otherwise defeat the face check;
- use bots, scripts, automation or modified clients against the service;
- probe, scan, overload or attempt to gain unauthorised access to any part of the service;
- scrape, harvest or store other people's data;
- break any law that applies to you or to the person you are talking to.
5. Other people's behaviour
We moderate, we act on reports, and we ban people who break the rules. But conversations are not recorded and are not watched as they happen — that is a deliberate privacy decision, and it means we cannot guarantee how anyone will behave.
If something goes wrong, press Report. If you believe a child is involved, report it and write to [email protected]. If you or someone else is in danger, contact your local emergency services first. We are not an emergency service and cannot intervene in real time.
6. Reporting and enforcement
Reports reach a person. Where we reasonably believe these terms or our rules have been broken we may end a conversation, restrict features, suspend access, or ban an account and the device behind it.
Ordinary breaches escalate: 24 hours, then 7 days, then permanent. Anything involving a minor, or sexual content involving a minor, skips that ladder entirely and results in an immediate permanent ban. Where the law requires it we will report the matter, and preserve what evidence we hold, to the relevant authorities.
If you believe you were banned in error, write to [email protected] and a person will look at it.
7. Content and rights
You keep whatever rights you have in what you say, type or show. You grant us only the narrow, non-exclusive, worldwide, royalty-free licence needed to transmit it to the person you are connected to, and to hold it briefly where that is technically necessary to deliver it. That licence ends when the conversation does. We do not archive, publish, sell or train on your conversations.
The Kismaro name, logo, site, software and design belong to us and are protected by copyright and trade mark law. You may not copy, adapt, reverse engineer or redistribute them except as the law expressly permits.
If you believe something on Kismaro infringes your copyright or trade mark, write to [email protected] with enough detail to identify the material, your contact details, and a statement that you are the rights holder or authorised to act for them.
8. Availability
The service is provided as it is and as available. We do not promise it will be uninterrupted, timely, secure or error-free, that you will be matched with anyone, or that any particular filter will find someone. We may change, suspend or withdraw any part of it, and we may do so without notice.
Fewer people are online here than on the largest sites in this category. A narrow country filter at a quiet hour may find nobody at all. That is a property of the service, not a fault.
9. No warranties
To the fullest extent the law allows, we exclude all warranties, conditions and terms implied by statute or common law, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant the identity, age, conduct, statements or intentions of any other user. The age check and the face check reduce risk; they do not eliminate it, and you should not treat them as a guarantee about the person you are talking to.
10. Limits on our liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive loss, nor for loss of profit, revenue, data, goodwill or anticipated savings, however caused.
We are not liable for the acts or omissions of other users, including anything said, shown, recorded or done by the person you are connected to.
Where liability cannot lawfully be excluded, our total aggregate liability to you for all claims is limited to one hundred United States dollars (US$100). Kismaro is provided free of charge, and that limit reflects it.
Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
11. Indemnity
You agree to indemnify and hold harmless Tech Interval LLC, its officers and its contractors against any claim, loss, liability or reasonable legal cost arising from your use of the service, your breach of these terms, or your infringement of anyone else's rights. We will tell you promptly of any such claim and will not settle it without consulting you.
12. Ending your use
You may stop at any time. You may ask us to delete your account by writing to [email protected], and what we keep afterwards is set out in the privacy policy — in particular we retain a record of a ban, because otherwise a ban could be erased by deleting the account.
We may end or restrict your access if you break these terms, or if we stop offering the service. Sections 7, 9, 10, 11, 13 and 14 survive the end of this agreement.
13. Disputes
Please write to us first. Most problems are a misunderstanding and are resolved in an email. Send it to [email protected] with enough detail for us to look into it, and we will respond within 30 days.
If that does not resolve it, these terms are governed by the law of the State of New Mexico, United States, without regard to its conflict-of-law rules, and the state and federal courts located in New Mexico have exclusive jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer law in your country of residence, nor of the right to bring proceedings there where the law gives you that right.
14. General
Changes. We may change these terms. The date at the top always shows when they last changed, and we will announce material changes on the site. Continuing to use Kismaro after a change means you accept it.
Severability. If any part of these terms is held unenforceable, the rest continues in force and the unenforceable part is read as narrowly as necessary to make it valid.
No waiver. If we do not enforce something straight away, we have not given up the right to enforce it later.
Assignment. You may not transfer your rights under these terms. We may transfer ours to a successor of the business, on notice, provided your rights are not reduced.
Entire agreement. These terms, the community rules and the privacy policy are the whole agreement between us about Kismaro.
Events outside our control. We are not liable for failure to provide the service caused by something beyond our reasonable control.
